These Terms & Conditions (the “Terms”) apply to your use of quality-crete.com (the “Website”) and to quotes, orders and deliveries of concrete and related services from Quality-Crete (“Quality-Crete,” “we,” “us” or “our”). By using the Website or placing an order, you agree to these Terms. If you are ordering on behalf of a company, you confirm you are authorized to bind it.
If a signed quote, proposal, credit application or contract with us conflicts with these Terms, that written agreement controls for the matters it covers.

1. Using Our Website
You may use the Website to learn about our products and services, estimate quantities and contact us. You agree not to:
- Use the Website for any unlawful purpose or submit false or misleading information.
- Submit requests in someone else’s name without their permission.
- Send spam, automated submissions or malicious code, or try to disrupt or gain unauthorized access to the Website.
- Copy or scrape the Website’s content for commercial use.
Your use of the Website is also governed by our Privacy Policy.
2. Accuracy of Website Information
We work to keep the Website accurate and current, but its content is general information only. It may contain errors or become out of date, and we may change it at any time without notice. Nothing on the Website is an offer to sell at a particular price or a substitute for a written quote or professional engineering advice.
Our concrete calculators and quantity guides produce estimates only. Actual quantities depend on field conditions such as subgrade, form dimensions and placement method. You are responsible for confirming the quantity and the mix your project requires.
3. Product and Service Descriptions
Photos, videos, mix descriptions, typical strengths, set times, colors and finishes shown on the Website are illustrative. Concrete is a natural product: color, texture and performance vary with materials, weather, placement, finishing and curing. The mix design, specifications and quantities confirmed for your order are what we supply. Not every product or service is available at every location or on every date.
4. Quotes and Estimates
Quotes and estimates are based on the information you give us, including mix, quantity, location, access, timing and placement method. They are valid for the period stated on the quote. If no period is stated, we may revise a quote before an order is confirmed. If project details change, the price may change.
5. Orders
Submitting a form on the Website — including “Order Concrete” or a quote request — is a request, not a confirmed order. An order is confirmed only when our team confirms the mix, quantity, delivery date, time window and job-site details with you by phone, email or in writing.
You are responsible for ordering the right product for your application and for the accuracy of the information you give us. If your project has plans or specifications from an engineer or public agency, provide them before the order is confirmed. We may decline or limit any order, including orders outside our service area or orders we cannot safely deliver.
6. Pricing
Because we mix concrete on site, you pay for the quantity of concrete we produce at your job site, as recorded by our equipment and on the delivery ticket, subject to any minimums and job requirements in your quote.
Pricing depends on factors including mix design, admixtures, color, quantity, travel distance, placement method, waiting time and scheduling. Additional charges may apply — for example for waiting time beyond the time allowed, after-hours, weekend or emergency delivery, trips that cannot be completed because of site conditions, or changes you request on site — as stated in your quote or confirmed with you before delivery. Prices do not include applicable taxes unless stated.
7. Payment
Payment is due as stated on your quote or invoice, or before or at delivery if you have not been approved for credit. We do not take payment through this Website; our team will tell you the payment methods available when your order is confirmed. Approved credit accounts are subject to the terms of the credit application.
Past-due balances may be charged late fees or interest as stated on your invoice or credit terms, not exceeding the maximum allowed by law, and you agree to pay reasonable costs of collection, including attorneys’ fees, to the extent permitted by law. We may suspend deliveries on accounts that are past due and may exercise any rights available to material suppliers under Florida law, including Part I of Chapter 713, Florida Statutes (the Construction Lien Law).
8. Cancellations and Changes
Please tell us as early as possible — by calling 1-877-QCMIXER — if you need to cancel, reschedule or change an order. Orders cancelled or changed after our equipment has been dispatched, or after materials have been prepared for a special mix, may be subject to a trip charge or other charges stated in your quote or confirmed with you at scheduling.
9. Delivery
Delivery dates and times are scheduled estimates. We work to arrive within the confirmed window, but traffic, weather, road conditions, equipment issues and earlier jobs can cause delays. Where you direct us, we will deliver to the point on your site you designate as accessible, but our driver may decline any location they reasonably consider unsafe or inaccessible.
Title to and risk of loss of the concrete pass to you as it is discharged from our equipment.
10. Customer Responsibilities
Unless we agree otherwise in writing, you are responsible for:
- Ordering the correct mix, strength and quantity for your application.
- Obtaining any permits, inspections, approvals and utility locates your project requires.
- Having forms, reinforcement, subgrade and crew ready when we arrive, and placing, finishing, jointing, curing and protecting the concrete properly.
- Any water, admixture or other change to the mix made at your request on site, which may reduce strength and affect performance.
- Having someone authorized on site to direct placement and sign the delivery ticket.
11. Job-Site Requirements
You agree to provide:
- Safe, legal and unobstructed access for our trucks and equipment, including adequate width, overhead clearance and firm ground able to carry a loaded truck.
- Accurate site information, including the locations of septic systems, irrigation, drainage and underground utilities in the delivery area.
- A designated area for washing out equipment, where required.
- A job site that meets applicable safety requirements.
When you or your representative direct our equipment beyond the curb line or onto private property, you accept responsibility for resulting damage to driveways, sidewalks, curbs, lawns, landscaping, septic systems and underground utilities, except to the extent caused by our negligence.
12. Delays, Weather and Access Issues
Concrete placement depends on weather and site conditions. We may postpone, pause or reschedule a delivery because of rain, lightning, storms, hurricane watches or warnings, extreme temperatures, unsafe or inaccessible site conditions, or other events beyond our reasonable control, such as material shortages, equipment failure, road closures, labor issues or government orders. We are not liable for delays or failures caused by these events or by site conditions that prevent safe delivery. If our crew arrives and cannot deliver because the site is not ready or accessible, waiting-time or trip charges may apply.
13. Concrete Quantity and Quality
We produce concrete to the mix design confirmed for your order, and the quantity produced is recorded on the delivery ticket. Please review the ticket before signing and tell us about any concern about quantity or quality before the concrete is placed, or as soon as possible afterward.
We are not responsible for:
- Shortfalls or overages caused by your quantity estimate, form or subgrade variations, spillage or waste on site.
- Results affected by water or materials added at your request, or by placement, consolidation, finishing, jointing, curing or protection that we did not perform.
- Normal characteristics of concrete, including hairline and shrinkage cracking, minor color and texture variations, and surface effects from weather.
- Strength test results from specimens that were not sampled, made, cured and tested according to the applicable ASTM standards.
If concrete we supplied does not meet the confirmed mix design, our responsibility is limited, at our option, to replacing the non-conforming concrete or refunding or crediting its price.
EXCEPT AS STATED IN THESE TERMS OR IN A WRITTEN WARRANTY SIGNED BY US, AND TO THE FULLEST EXTENT PERMITTED BY LAW, OUR PRODUCTS AND SERVICES ARE PROVIDED WITHOUT ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE WEBSITE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
14. Intellectual Property
The Website and its content — including the Quality-Crete name and logo, text, photos, videos, graphics and calculators — are owned by or licensed to Quality-Crete and protected by copyright, trademark and other laws. You may view and print pages for your own use in connection with a project. You may not copy, modify, distribute or use our content or trademarks for any other purpose without our written permission.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, QUALITY-CRETE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DELAY DAMAGES, LABOR COSTS OR THE COST OF REMOVING OR REPLACING CONCRETE, ARISING FROM THE WEBSITE OR ANY ORDER. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE CONCRETE OR SERVICES THAT GAVE RISE TO THE CLAIM.
These limits do not apply where the law does not allow them, including liability for our gross negligence or intentional misconduct.
16. Indemnity
To the extent permitted by law, you agree to indemnify and hold Quality-Crete harmless from claims, losses and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms, inaccurate information you provide, or conditions at your job site, except to the extent caused by our negligence or misconduct.
17. Dispute Resolution
If you have a concern about an order or these Terms, contact us first at 1-877-QCMIXER or hello@quality-crete.com. Most problems can be solved quickly this way. If we cannot resolve a dispute informally within 30 days, either of us may bring a claim in the state or federal courts described below, or in small claims court if the claim qualifies.
18. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any lawsuit relating to these Terms, the Website or an order must be brought in the state or federal courts located in the Florida county where Quality-Crete has its principal place of business, and you and we consent to their jurisdiction.
19. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. You may not assign your rights under these Terms without our consent.
20. Changes to These Terms
We may update these Terms from time to time by posting a new version on this page and changing the “Last updated” date above. Changes apply to Website use and orders confirmed after they are posted; orders already confirmed remain under the Terms in effect when they were confirmed.
